About this document

These terms apply when Northside Home Solutions supplies building, roofing, heating, plumbing, installation, repair, maintenance or home improvement services to a customer. The written quotation and any project-specific documents form part of the agreement.
Nothing in these terms removes or limits rights that a consumer has under law.

In these terms, “we”, “us” and “our” mean the supplier. “You” and “your” mean the customer named in the quotation or order.

2. Quotations and estimates

A quotation describes the work, price assumptions and any stated exclusions. It is valid for the period written on it. If no period is stated, ask us to confirm that the price remains available before accepting it.
An estimate is an informed indication rather than a fixed price. We will identify a document as an estimate where the final cost depends on investigation, quantities, hidden conditions or information that is not available at the time.
Prices are based on the information and access available when the document is prepared. Unless the quotation says otherwise, it does not include planning fees, building control charges, structural calculations, specialist surveys, utility-company charges, asbestos removal, decoration or work by others.

3. Forming the contract

A contract is formed when we confirm acceptance of your instruction in writing, or when we accept a deposit or other payment requested in the quotation. A website enquiry or quote request does not by itself create a contract.
The contract consists of the accepted quotation, these terms, any agreed drawings or specification, the payment schedule and later written variations. If documents conflict, the project-specific quotation or written variation takes priority for that issue.
You must tell us promptly if any name, address, ownership, access or project information is wrong.

4. Scope of work

We will carry out the work described in the accepted quotation. Items not listed are not included merely because they are nearby or become visible during the project.
Measurements, photographs, discussions and website content help explain the work but do not expand the written scope unless the change is agreed. Product images and samples can vary in colour, grain, texture and appearance from installed materials.
If the work involves diagnosing a leak, intermittent fault or concealed defect, we will use reasonable care and skill but cannot guarantee that every cause will be confirmed without opening, testing or further work.

5. Price, VAT and payment

The price and payment stages are stated in the quotation. The quotation will say whether VAT is included or applicable. You must pay invoices by the due dates shown.
A deposit is a payment towards the contract price and may also cover ordered materials, design work, booked labour and other committed costs. Any amount retained following cancellation must be fair and reflect rights under consumer law and losses that we cannot reasonably avoid.
If an undisputed payment is overdue, we may pause work after giving reasonable notice. We will take reasonable steps to protect completed work and the property before leaving site. Pausing may affect the programme and availability of labour or materials.

6. Start dates and programme

Any start date or completion period is based on information available when agreed. Unless expressly stated as guaranteed, it is an expected programme rather than a strict deadline.
Weather, unsafe conditions, hidden defects, material delays, changes requested by you, late decisions, unavailable access, approval delays and events outside reasonable control may affect timing. We will tell you about a material delay and update the programme when reasonably possible.
Roofing and external work may need to be rescheduled when weather would make the work unsafe or prevent materials from being installed correctly.

7. Your responsibilities

You must provide safe and reasonable access to the property, working areas, water, electricity and welfare facilities where agreed. You must secure pets, remove or protect fragile and valuable items and tell us about known hazards, asbestos, concealed services, alarms, access restrictions and relevant property rules.
You confirm that you own the property or have authority from the owner to instruct the work. You are responsible for party wall matters, landlord or freeholder consent and other third-party permissions unless the quotation expressly places that work with us.
Children, visitors and occupants must be kept away from work areas, tools, materials, scaffolding and open structures.

8. Planning permission and Building Regulations

The quotation will state who is responsible for checking and obtaining planning permission, Building Regulations approval, listed building consent, party wall notices and other permissions.
You must not assume that approval is unnecessary because similar work exists nearby or because the project is described as a repair. We may pause affected work if a required approval, design or inspection has not been obtained.
Fees and work required by an authority after the quotation are additional unless expressly included.

9. Hidden conditions and additional work

Building work can reveal rotten timber, damaged decks, unsafe wiring, defective pipework, asbestos, structural movement, hidden leaks, inadequate support or earlier work that does not meet the expected standard. These conditions may not be visible during the initial survey.
We will explain the issue and, where practical, provide a price or basis of charge before carrying out additional non-urgent work. If immediate action is reasonably necessary to make the property safe or weatherproof, we will try to contact you and limit the action to what is reasonably required.

10. Variations

A variation is a change to the agreed work, materials, design, sequence or access. Variations should be agreed in writing and may change the price and programme.
Instructions given to workers on site do not automatically change the contract. Please direct requested changes to the person managing the project so cost, availability and consequences can be confirmed.
If you ask us to remove agreed work, the price reduction may take account of materials already ordered, work already completed and costs that cannot reasonably be avoided.

11. Materials and products

We may use equivalent products where an item becomes unavailable, but will seek agreement where the change materially affects appearance, performance or price.
Manufacturer warranties are subject to the manufacturer’s terms, registration, servicing and exclusions. We do not extend a manufacturer warranty unless the quotation expressly says so.
Products supplied by you must be suitable, complete, undamaged and available when needed. We are not responsible for delay, missing parts, incorrect measurements or product defects arising from customer-supplied items, although we will tell you about problems we identify.

12. Standard of work and your legal rights

We will perform the service with reasonable care and skill. Materials we supply will be as described and of satisfactory quality where the law requires it.
If you believe work is defective, tell us promptly and allow a reasonable opportunity to inspect and, where appropriate, repeat or correct the work. This does not reduce any remedy available under the Consumer Rights Act 2015 or other applicable law.

13. Completion and minor items

Work is complete when the contracted service is substantially finished and can be used for its intended purpose, subject to minor outstanding items that do not prevent normal use.
Any snagging list should be reasonable, relate to the agreed scope and be provided promptly. Minor outstanding items do not justify withholding an amount that is disproportionate to the reasonable cost of dealing with them.

14. Cancellation rights

If you are a consumer and the contract is made online, by phone or at your home, you may have a legal right to cancel within 14 days without giving a reason. The exact right and any exception depend on how and where the contract was made and what is being supplied. We will provide the required cancellation information and model cancellation form where the law applies.
If you ask us in writing to start services during the cancellation period and then cancel, you may have to pay a proportionate amount for work supplied before cancellation. If the service is fully performed during that period following the required request and acknowledgement, the cancellation right may end.
Different rules can apply to bespoke or made-to-measure goods. This does not automatically remove cancellation rights for associated services. Legal rights cannot be removed by a statement in these terms.

15. Cancellation outside a statutory cooling-off period

You may ask to cancel by contacting us in writing. Where there is no statutory right to a full refund and we are not in breach, we may charge for work completed and losses caused by cancellation that we cannot reasonably avoid. This may include committed materials, design work, booked specialist services and reasonable loss of profit, but any amount must be fair and proportionate.
We may cancel or suspend the contract for a serious reason, including unsafe working conditions, threatening behaviour, persistent non-payment, lack of lawful access or refusal to obtain a required approval. We will give reasonable notice where the circumstances allow and explain the financial position.

16. Damage, insurance and liability

We are fully insured for the work we undertake, subject to the terms and limits of our policies.
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill. We are not responsible for pre-existing defects, hidden conditions we could not reasonably identify, or loss caused by inaccurate information, unsafe customer instructions or work by others.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or statutory consumer rights that cannot be excluded.

17. Complaints

Please raise a concern as soon as possible so it can be investigated while the facts and site conditions are clear. Contact info@northsidehomesolutions.co.uk with the property address, project details and a description of the issue.
We will acknowledge the complaint, investigate it and explain the proposed response.

18. Personal information

We use personal information to manage enquiries, quotations, contracts, payments, suppliers, project records, warranties and complaints. More information is provided in our Privacy Policy.

19. General terms

If a court finds part of these terms unlawful or unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not waive that right.
No person other than you and us has a right to enforce the contract, except where the contract expressly says otherwise.
These terms and the contract are governed by the law of England and Wales. A consumer can bring proceedings in the courts that have jurisdiction under applicable consumer law.
